Guru Prasad Swami's action of assault, embezzlement and fraud
| ABOUT MEXICO LEGAL from: RK Dear PADA, In relation to the note regarding Mexico that appeared in the last issue of PADA I want to state the following as a clarification. Please post it: There
is indeed a motion to investigate the activities of the local GBC, Guru
Prasad Swami, due to both his performance as GBC of Mexico for the past
12 years as well as some illegal acts in Mexico that can be traced back
to him. Although some people, beginning with Guru Prasad Swami, would want to dismiss the whole issue saying that "it is being instigated by Radha Krsna dasa," actually the opposite is true. An independent group of devotees here presented a letter to the GBC a month ago requesting his removal and I only found about it later. Others just want to go ahead and prosecute him for a felony that he was involved in and send him unceremoniously to jail. He is also an illegal alien here because he comes with a tourist visa when in fact he is involved in a religious group. Government agents can put him in a plane to the U.S. within a couple of hours of someone complaining to the authorities. I have actually discuraged these devotees from taking any action and suggested to first present this issue to the GBC volunteering my assistance in presenting the case (I sound naive but lets see what happens). The
Chairman of the GBC has been contacted and an investigative team has been
assigned. So far the GBC has fared well in their attitude towards this case
because they have shown interest and given us pointers on how to present
the case. Still there is a long way ahead. The investigation needs to be
carried out and then some conclusions reached regarding Guru Prasad Swami.
There is plenty of room for maneuvers and tricks along the way but the devotees
here will keep their eyes open for any mischief. It is better to reach an
internal solution than having a nasty scene simply out of respect to Srila
Prabhupada's ISKCON. In any case there is a GBC resolution (96-1993) regarding
ISKCON's Judicial System:"No court in ISKCON shall hear cases which are recognized as being of a criminal nature in the outside world. Examples of this are child molestation, assault and battery, grand larceny, murder, embezzlement and fraud. Certified cases of an obvious nature should be turned over to the local governmental authorities and follow the normal criminal system of justice." This
means that the actions of Guru Prasad Swami, which are in the category
of assault, embezzlement and fraud, shouldn't even be heard by the GBC Investigators.
Somehow the Swami doesn't seem to fully understand this and thinks that
through some quick maneuvers here and there he will be able to put out the
fires. Unfortunately for him any Mexican has the constitutional right to
denounce such illegalities without any "approval" from the GBC.
The fact that this whole issue is being presented first to the GBC is only
for two reasons: 1) To help create a group spirit among the Mexican devotees
and realize how much can be achieved through unity. And 2) That by presenting
this to the GBC, the Body may become more aware of the need of making their
members accountable for their actions and actually monitor their performance.I think that with all the worldwide potential legal cases ahead, the GBC investigators here will prefer to take the obvious and natural desitions for their sake and that of their own overwhelmed peer. YS RK Mexico
